The 1099 Threshold Rose to $2,000: What Small Business Owners Should Update
If you pay a few contractors or run a restaurant, salon, clinic or online shop, fewer small payments may need a federal 1099 for 2026, because the threshold for certain payments is now $2,000. Employers, on the other hand, have more to report on W-2s. The 1099-K threshold is generally still more than $20,000 and more than 200 transactions. California's separate EDD independent-contractor report (DE 542) is not affected. Updating vendor files and payroll settings now helps you meet the early 2027 deadlines.
Short answer
For payments made in 2026, fewer small contractor payments need a federal 1099, but employers have more to report on W-2s. California's separate EDD independent-contractor report (DE 542) is not affected. If you run a restaurant, salon, clinic, e-commerce shop or professional practice in California, update vendor files and payroll settings now, before the early 2027 deadlines.
Key facts and figures
- The federal 1099-NEC and 1099-MISC threshold for certain payments is $2,000 for tax years beginning after 2025 (IRS).
- Form 1099-K is generally required only above $20,000 and more than 200 transactions (IRS).
- California's EDD independent-contractor report (DE 542) is still triggered at $600 (EDD).
- 2026 Forms W-2 add box 12 codes including TT (overtime) and TP (tips), plus TA, and box 14b (IRS).
- California does not follow the federal tips and overtime deductions (FTB).
Forms 1099-NEC and 1099-MISC: $2,000 threshold
For tax years beginning after 2025, the minimum threshold for reporting certain payments on information returns, and for backup withholding on those payments, increased to $2,000. The statute applies the change to payments made after December 31, 2025 (P.L. 119-21 §70433(f)), which is the same line for a calendar-year payer. The Form 1099-MISC/NEC instructions say it may be adjusted for inflation beginning in calendar year 2027, while Pub. 1099 says it will be adjusted (Form 1099-MISC/NEC instructions; Pub. 1099). The previous threshold was $600 (2025 instructions). Not every box moved: for example, gross proceeds paid to attorneys in box 10 of Form 1099-MISC still use $600.
Forms 1099-NEC and 1099-MISC also gain new boxes for cash tips, the Treasury Tipped Occupation Code and qualified overtime (1099-NEC boxes 1b to 1d; 1099-MISC boxes 13a, 13b, 14).
California's separate EDD independent-contractor report (DE 542) is not affected: it is still triggered at $600 for individuals, sole proprietors and single-member LLCs, within 20 days (EDD).
Illustrative example (illustrative numbers)
A dental office pays a bookkeeper $1,800 and a marketing contractor $2,400 during 2026. Under the $2,000 federal threshold, the office generally files Form 1099-NEC for the marketing contractor only. It should still keep Forms W-9 for both. In California, if both are individuals, sole proprietors or single-member LLCs, the office may still need to file a DE 542 for each of them, because both payments exceed $600.
Form 1099-K: back to $20,000 and 200
OBBBA restored the prior rule: a payment settlement entity is generally not required to file Form 1099-K unless the payee's gross payments exceed $20,000 and the number of transactions exceeds 200 (IRS). Income is taxable whether or not a 1099-K is issued, so keep your own sales records. Personal transfers on apps are a separate question; see Alipay and WeChat Pay reporting.
Forms W-2: overtime and tips
- Box 12, code TT: total qualified overtime compensation, meaning only the premium portion, such as the "half" of time-and-a-half.
- Box 12, code TP: total cash tips reported to the employer.
- Box 12, code TA: employer contributions to a Trump account under a section 128 program, also new for 2026.
- Box 14b: Treasury Tipped Occupation Code(s); the old box 14 becomes box 14a. If any of an employee's tips were received in a nonqualifying occupation, "000" must be entered as one of the codes.
These support the federal deductions for qualified overtime (up to $12,500, or $25,000 for joint filers) and qualified tips (up to $25,000). Both phase out above $150,000 of modified AGI ($300,000 for joint filers) and apply for tax years 2025 through 2028 (W-2 instructions; IRS summary; FTB summary). For the wider list of 2026 changes, see OBBBA 2026: federal vs California.
Illustrative example (illustrative numbers)
A line cook earns $30 per hour and works 200 FLSA overtime hours at time-and-a-half. Only the premium portion counts: $30 x 0.5 x 200 = $3,000, which is the amount reported with code TT.
Overtime and tips generally remain subject to withholding and payroll taxes. The deduction is taken on the worker's own return.
California
The FTB says California does not conform to the federal tips or overtime deductions, but does conform to the related information return provisions (FTB). California employees who claim the federal deductions will generally still pay state tax on that income.
The federal $2,000 change does not touch the EDD report. EDD says to report an independent contractor within 20 calendar days of paying, or entering a contract for, $600 or more with an individual, sole proprietor or single-member LLC; the contract can be written or verbal (EDD). Keep your DE 542 process at $600.

Checklist
- Update federal accounts payable rules to the $2,000 threshold for Forms 1099-NEC and 1099-MISC; keep W-9s for all vendors.
- Keep the $600 trigger for California DE 542 reports (individuals, sole proprietors and single-member LLCs, within 20 days).
- Ask your payroll provider to map overtime premium and tips to codes TT and TP, any Trump account contributions to code TA, and tipped occupations to box 14b (with "000" if any tips are from a nonqualifying occupation).
- If you file through software, check that it uses IRIS: the IRS e-file system FIRE is retired and IRIS is the only intake system for 2026 returns filed in 2027 (Pub. 1099).
- Reconcile 1099-K forms you receive against your own sales.

Frequently asked questions
What is the 2026 Form 1099-NEC threshold?
$2,000. For tax years beginning after 2025 the federal threshold for certain information returns rose from $600 to $2,000. The 1099-MISC/NEC instructions say it may be adjusted for inflation beginning in 2027 and Pub. 1099 says it will be (Form 1099-MISC/NEC instructions; Pub. 1099).
When are 2026 Forms 1099-NEC due?
Form 1099-NEC is due January 31, and when a due date falls on a weekend the next business day applies (General Instructions). January 31, 2027 is a Sunday, so the date is February 1, 2027 by that rule.
Did the 1099-K threshold go back to $20,000?
Yes. Payment settlement entities generally file Form 1099-K only if payments exceed $20,000 and the number of transactions exceeds 200 (IRS).
What do codes TT and TP on Form W-2 mean?
Code TT in box 12 reports qualified overtime compensation and code TP reports cash tips reported to the employer; new code TA reports employer Trump account contributions. Box 14b shows the Treasury Tipped Occupation Code, and "000" is entered if any tips were received in a nonqualifying occupation (W-2 instructions).
Does California allow the tips and overtime deductions?
No. The FTB says California does not conform to the federal tips or overtime deductions, though it does conform to the related information return provisions (FTB).
Does the $2,000 threshold change California's DE 542 independent-contractor report?
No. California's separate EDD independent-contractor report (DE 542) is not affected: it is still triggered at $600 for individuals, sole proprietors and single-member LLCs, within 20 days (EDD).
